1. General Agreement

By purchasing, using, or having any products installed by Garden Play Ireland (“the Company”), you (“the Customer”) agree to be bound by these Terms and Conditions. This agreement outlines your rights and obligations, along with the Company’s rights and limitations of liability.

2. Product Information and Safety

   – 2.1 Suitability: The Company’s products are designed for children within specific age ranges. It is the responsibility of the Customer to ensure the product is suitable and used only by children within the recommended age range.

   – 2.2 Supervision Requirement: All playhouses should be used under adult supervision. The Company is not responsible for injuries caused by lack of supervision or misuse.

   – 2.3 Regular Maintenance: To ensure safety and durability, playhouses must be inspected regularly by the Customer. This includes checking for loose parts, sharp edges, or signs of damage.

   – 2.4 Indoor and Outdoor Use: The Company designs pieces for primarily indoor, but the Customer should ensure that the placement and environment (e.g., weather exposure) are appropriate. The timber products are made from pressure treated timber, but it is recommended to treat it regularly, using the specific treatment guidelines, to maintain the high timber quality and prolong the life and safety of the product.

-2.5 Surfaces: Garden Play Ireland will endeavour to level the product as much as possible if on uneven ground. Installation is based off a grass surface – if Garden Play Ireland cannot securely install the product to the ground the onus is on owner and use is not recommended before safe installation is completed.

3. Orders and Customization

   – 3.1 Custom Orders: The Company may offer customized designs based on Customer specifications. Once customization has been agreed upon and the order confirmed, no changes or cancellations can be made.

   – 3.2 Order Confirmation: It is the Customer’s responsibility to ensure the accuracy of all order details. Any omissions or inaccuracies should be reported immediately.

4. Delivery and Installation

   – 4.1 Delivery Only: Smaller products which don’t require installation/assembly will be sent via a courier. This is usually completed within 5 – 7 working days if not beforehand. The Company will not be liable for delays outside its control.

 – 4.2 Delivery/Installation: The Company will provide estimated delivery, assembly & installation dates, but delays may occur due to unforeseen circumstances. The Company will not be liable for delays outside its control.

   – 4.3 Installation Site: It is the Customer’s responsibility to ensure that the installation site is prepared and accessible. Any additional costs incurred due to site inaccessibility will be the Customer’s responsibility.

   – 4.4 Installation: The Company will install the playhouse according to its safety standards. Following installation, the Customer is responsible for ensuring the playhouse is maintained and used according to the provided guidelines.

5. Returns

   –We accept returns within 14 days of purchase. Customers can choose a refund to the original payment method, a credit note, or an exchange, based on their preference.

 – 5.1 Conditions for returns:  

Items must be in new, unopened, and unused condition.

Products must be returned in their original packaging, including the pallet (if applicable), and in retail saleable condition.

The buyer is responsible for all return and shipping costs.

– 5.2 Eligibility Requirements for Refunds:

Assembled items cannot be returned

Items must be returned in their original, undamaged packaging with all documentation and intact tamper-proof seals

A valid receipt must accompany the return.

Garden Play Ireland reserves the right to reject returns if the items are used, damaged, missing parts, or otherwise unsaleable.

Refunds will be processed within 14 days of receiving the returned item, excluding initial shipping costs. 

Refunds will be issued to the same payment method used for the original purchase.

5.3 Exchanges

Items can be exchanged within 14 days, provided they are in new, unopened, and unused condition. Products must be returned in their original packaging, including the pallet (if applicable), and in retail saleable condition.

Please Note:

This policy applies only to boxed items and excludes assembled products such as Swing Sets and Kids’ Electric Cars which are preassembled.

The buyer is responsible for all return and shipping costs.

General Return Guideline

A restocking fee of up to 20% may apply for returned items that meet the new, saleable condition criteria.

No refund will be provided for used items.

All returns must include original accessories and packaging.

Once we receive and inspect your return, we will notify you of its approval or rejection. If approved, we will process the refund accordingly.

6. Limited Warranty

   – 6.1(a) Warranty Coverage: The Company provides a limited warranty covering defects in materials and workmanship for 1 year from the date of installation. This warranty is void if the playhouse is misused, improperly maintained, or modified without authorization.

– 561(b) All our ride on toys carry 3 months warranty on batteries, 3 months warranty on spare parts. This is for electrical components only, wheels and exterior plastic parts are not covered* and parts will not be replaced if the product has been misused in any way.

*If the parts arrive damaged they will be replaced but Garden Play Ireland must be notified immediately who will in turn organise replacement parts

*Garden Play Ireland do not carry out, or will not be responsible for, the repairs.

   – 6.2 Exclusions: The warranty does not cover normal wear and tear, weather-related damage, damage caused by installation on unsuitable sites, or accidents not attributable to manufacturing defects.

   – 6.33 Claims: Warranty claims must be made within the warranty period. The Company reserves the right to repair or replace defective components at its discretion.

7. Limitations of Liability

   – 7.1 Indirect Damages: The Company is not liable for indirect, incidental, or consequential damages arising from the purchase, installation, or use of its products.

   – 7.2 Personal Injury and Property Damage: The Company is not responsible for any injuries, property damage, or losses resulting from the improper use, lack of supervision, or poor maintenance of its playhouses.

   – 7.3 Safety Compliance: The Customer is responsible for complying with local safety regulations. The Company disclaims any responsibility for penalties or damages arising from failure to adhere to such regulations.

8. Assumption of Risk

By purchasing and using the playhouse, the Customer acknowledges that all play equipment carries inherent risks, including the risk of falls, injury, or other harm. The Customer assumes all responsibility for these risks and agrees to indemnify the Company against any claims arising from use of the product.

9. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Ireland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the Republic of Ireland.

10. Modifications to Terms

The Company reserves the right to modify these Terms and Conditions at any time. Customers will be notified of significant changes, and continued use of the Company’s products constitutes acceptance of the updated Terms.

These terms and conditions provide a general legal foundation, covering product suitability, installation responsibilities, warranty limitations, and liability disclaimers. To maximize legal protection, consult a legal professional for a tailored review.

NOTE:
Splits and cracks will form in timber as it expands and contracts due to changes in humidity and temperature. These cracks DO NOT compromise the strength, integrity, or durability of the play equipment. Because timber is a natural, living material, it expands and contracts throughout the year, often resulting in the appearance of substantial cracks.
